Terms and Conditions

Please read these Terms and Conditions carefully before using our website or purchasing any of our products and services. By placing an order or using our services, you agree to be bound by these terms. If you have any questions, please contact us before purchasing.

1 About Us

These Terms and Conditions govern the relationship between you (the client) and Pocket Video School, a sole trader business trading as Friction Point Video, with its principal place of business at:

References to "we", "us", "our", or "Friction Point Video" throughout these Terms and Conditions refer to Pocket Video School trading as Friction Point Video. References to "you" or "your" refer to the individual or business purchasing our products or services.

2 Our Products and Services

Friction Point Video offers the following products and services. Each is subject to these Terms and Conditions, as well as any specific terms noted below:

All prices are quoted in GBP (British Pounds Sterling) and are exclusive of VAT. Friction Point Video is not currently VAT registered. Prices are subject to change but any changes will not affect orders already confirmed in writing.

3 Forming a Contract

A legally binding contract between you and Friction Point Video is formed in one of the following ways:

  • For digital products (The Friction Snapshot, Friction Audit Lite): when payment is received and confirmed by our payment processor.
  • For production services (The Friction Fix, Quick-Start Sprint, Selling 7 Accelerator): when you have confirmed your agreement in writing (by email) and payment or a deposit has been received.
  • For retainer services (Friction Partner Retainer, Interactive Video Hosting): when you have confirmed the arrangement in writing and the first month's payment has been received.
  • For the Friction Fix Case Study: when you have confirmed your agreement to the case study terms in writing by email and payment has been received.

We reserve the right to decline any order or enquiry at our discretion, in which case any payment received will be refunded in full.

4 Payment Terms

Digital Products

Payment for The Friction Snapshot and Friction Audit Lite is required in full at the time of purchase. Delivery of the product is conditional on successful payment being received.

Production Services

For The Friction Fix, Quick-Start Sprint, and Selling 7 Accelerator, full payment is required before the shoot date is confirmed, unless otherwise agreed in writing. Invoices are due within 7 days of issue unless an alternative arrangement has been agreed.

Retainer Services

For the Friction Partner Retainer and Interactive Video Hosting, payment is due monthly in advance on the date agreed at the start of the arrangement. Late payment may result in suspension of services.

Late Payment

We reserve the right to charge interest on overdue invoices at a rate of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

5 Delivery and Timelines

The Friction Snapshot

The Friction Snapshot report is delivered automatically by email within approximately 60 seconds of your form submission. In exceptional circumstances (such as technical issues), delivery may take up to 24 hours. If you have not received your report within 24 hours, please contact us at mark@frictionpointvideo.com.

The Friction Audit Lite

Your personalised Loom video audit will be delivered to your inbox within 48 hours of your order being placed. We aim to deliver sooner where possible.

Production Services

Shoot dates are agreed at the time of booking. Edited videos are delivered within 7 working days of the shoot date unless otherwise agreed in writing. Delivery is subject to the client providing timely feedback on revisions.

Delays Caused by the Client

Where a delay in delivery is caused by the client — including failure to provide information, access to personnel or locations, or timely feedback on revisions — we accept no responsibility for the resulting delay and our delivery obligation is adjusted accordingly.

6 Cancellation and Retainer Terms

Friction Partner Retainer

The Friction Partner Retainer requires a minimum commitment of 3 months from the start date. After the initial 3-month period, the retainer continues on a rolling monthly basis. To cancel, you must provide a minimum of 30 days' written notice before your next billing date. Notice given after a billing date has passed will take effect from the following billing cycle.

Interactive Video Hosting

The Interactive Video Hosting service continues on a rolling monthly basis. To cancel, you must provide a minimum of 30 days' written notice before your next billing date. Upon cancellation and expiry of the notice period, all interactive video elements hosted by Friction Point Video will be unpublished from our system and will no longer appear in locations where they have been embedded. You will retain the underlying video files, which can be used as standard (non-interactive) videos. Friction Point Video accepts no liability for any disruption to your website or marketing materials resulting from the removal of interactive video content following cancellation.

Production Projects

Where a production project is cancelled by the client after work has commenced, Friction Point Video reserves the right to retain payment in proportion to the work completed. The specific amount retained will be at our discretion, taking into account time invested, resources committed, and third-party costs incurred. Any cancellation must be made in writing.

7 Client Responsibilities

To enable us to deliver our services effectively, you agree to:

  • Provide accurate and complete information when requested, including website URLs, business descriptions, and contact details.
  • Make relevant team members available for filming on agreed shoot dates. Where agreed participants are unavailable on the day, we accept no responsibility for any resulting impact on the deliverables.
  • Ensure that filming locations are suitable, accessible, and reasonably quiet on the agreed shoot date.
  • Provide feedback on video edits within a reasonable timeframe. Unreasonable delays in providing feedback may affect the delivery timeline.
  • Ensure that you have the right to use any materials, logos, branding, music, or other content you provide to us for inclusion in your videos. You indemnify us against any claims arising from your failure to obtain appropriate permissions.
  • For the Friction Fix Case Study, honour the commitments set out in the case study agreement email, including uploading videos within 48 hours of delivery, completing the 30-day tracking process, and participating in a video testimonial.

8 Intellectual Property

Ownership of Deliverables

Upon receipt of full and final payment, all video content produced by Friction Point Video for your business is transferred to you for unlimited commercial use. You may use the videos on your website, in email communications, on social media, in proposals, and in any other business context without restriction.

Our Materials

All other materials produced by Friction Point Video — including but not limited to the Form Page Cheat Sheet, Website Friction Score, Friction Snapshot reports, Friction Audit Lite recordings, question frameworks, deployment guides, strategy documents, email content, website copy, and any other resources — remain the intellectual property of Pocket Video School trading as Friction Point Video. These materials may not be reproduced, resold, or distributed without our express written permission.

Our Right to Reference Your Work

Unless you have requested otherwise in writing before work commences, we reserve the right to reference your business as a client and to include examples of our work produced for you in our portfolio, on our website, and in our marketing materials. For Friction Fix Case Study clients, the specific case study terms agreed in writing at the start of the project govern the use of your name, business, results data, and testimonial.

Third Party Content

Where we use royalty-free music, stock footage, or other licensed third-party content in your videos, we will ensure appropriate licensing is in place. The terms of those licences form part of your right to use the finished video.

9 Limitation of Liability

We take our work seriously and we stand behind it. However, to the extent permitted by law:

  • We make no guarantee that the use of our products or services will result in specific business outcomes, including increased leads, sales, website conversions, or revenue. Results will vary depending on how our recommendations and deliverables are implemented.
  • The Friction Snapshot is an automated report and is provided on an "as is" basis. While we take care to ensure the accuracy and relevance of the automated analysis, we cannot guarantee that the report will identify every issue on your website or that all recommendations will be appropriate for your specific circumstances.
  • Our total liability to you in connection with any product or service shall not exceed the amount you paid for that product or service.
  • We are not liable for any indirect, consequential, or economic losses arising from the use of our products or services, including loss of profits, loss of business, or loss of data.
  • Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other matter for which it would be unlawful to exclude liability.

10 Data Protection

We process your personal data in accordance with our Privacy Policy, which forms part of our agreement with you and is available at www.frictionpointvideo.com/privacy-policy. By purchasing our products or services, you confirm that you have read and understood our Privacy Policy.

By using the Friction Snapshot, you acknowledge and consent to the fact that the information you provide — including your website URL, company name, and business description — is processed by OpenAI's API to generate your automated report. OpenAI's own terms and privacy policy apply to this processing. We do not store the content of your report beyond the delivery email.

11 Governing Law and Disputes

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We are committed to resolving disputes fairly and efficiently. If you have a complaint or concern, please contact us in the first instance at mark@frictionpointvideo.com. We will acknowledge your complaint within 2 working days and aim to resolve it within 14 working days.

12 Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be published on this page with an updated "last updated" date. The terms in force at the time your order is placed govern that transaction. We will notify active retainer clients of any material changes by email with a minimum of 30 days' notice.
